TerraCut Studios ("TerraCut," "we," "us," or "our") respects your privacy and is committed to protecting it. This Privacy Policy describes how we collect, use, disclose, and safeguard information about visitors to our website at terracutstudios.com (the "Site"), users of any TerraCut mobile application (the "App"), and clients, members, and visitors of our studio located at 270 E Houston St, New York, NY 10002 (collectively, the "Services"). By using the Site or App, booking a class, becoming a member, or visiting our studio, you agree to the practices described in this Policy.

This Policy applies only to information collected by TerraCut. If you navigate to a third-party website or platform linked from our Site or App, that third party's own privacy policy will govern.

1. Information we collect

1.1 Information you provide directly

We collect information you provide to us when you visit our Site or App, register for an account, book a class, purchase a membership or class pack, contact customer service, or otherwise interact with our staff or Services. Depending on how you interact with us, this may include:

  • Name, email address, mailing address, and phone number
  • Date of birth and gender
  • Payment and billing information (processed through our third-party payment and booking provider)
  • Purchase and booking history, including class packs, membership tier, and reservations
  • Emergency contact name and phone number, which we require in order to participate in a class
  • Health, injury, or physical limitation information you voluntarily share with an instructor or front desk staff for class safety purposes
  • Login credentials for your account
  • Any other information you voluntarily submit to us, such as through a contact form, waiver, waitlist signup, or job application

You may browse the Site anonymously, but certain features — such as booking a class or purchasing a membership — require you to provide personal information.

1.2 Information we collect automatically

When you use our Site or App, we and our service providers automatically collect certain information, including:

  • Domain name, browser type, and operating system
  • IP address and general location derived from it
  • Pages viewed, links clicked, and length of time spent on the Site or App
  • Referring URL or webpage that led you to our Site
  • Mobile device ID, device name and model, and app activity, if you use our App
  • With your permission, precise location data from your mobile device, to help you find the nearest TerraCut studio or receive relevant notifications
  • With your permission, calendar or contacts access, to help you manage class bookings or add an emergency contact

1.3 Information we collect in-studio

Our studio is monitored by closed-circuit video for loss-prevention and safety purposes. Footage may be reviewed and, where necessary, shared with law enforcement or used to protect the rights, property, or safety of TerraCut, our staff, or our clients and visitors.

If in the future we install connected fitness equipment or wearable devices at the studio, we may also collect performance metrics such as heart rate, pace, or effort during class. We do not currently collect biometric performance data through our reformers.

1.4 Information from other sources

We may also receive information about you from:

  • Other clients, such as when someone lists you as an emergency contact or refers you to TerraCut
  • Our booking and scheduling platform (currently AXLE) and other service providers who support our operations
  • Social media platforms, when you engage with our content or log in through a social account
  • Marketing and advertising partners, when you interact with our ads
  • Publicly available sources
  • Data analytics providers who help us understand Site and App usage

2. Cookies and other tracking technologies

Our Site and App use cookies, web beacons (pixel tags), and similar technologies to recognize your browser or device, remember your preferences, keep you logged in, and understand how our Services are used.

  • Cookies: small files placed on your device by your browser. You can set your browser to block or alert you to cookies, though some Site features may not function properly if you do.
  • Web beacons / pixel tags: small graphics embedded in pages or emails that help us track engagement, including whether an email was opened.
  • Analytics tools (e.g., Google Analytics) that help us evaluate Site and App usage in the aggregate.
  • Advertising technologies that may be used to serve TerraCut ads on other websites or social platforms based on your activity.

We attempt to honor recognized "Do Not Track" browser signals where technically feasible, but there is no common industry standard for how DNT signals should be interpreted, so we cannot guarantee every tracking mechanism will respect it. You can also manage interest-based advertising through the Digital Advertising Alliance (optout.aboutads.info) or the Network Advertising Initiative (optout.networkadvertising.org).


3. How we use your information

We use the information we collect to:

  • Create and manage your account and process bookings, membership sign-ups, and class pack purchases
  • Process payments through our third-party payment processor
  • Communicate with you about your bookings, account, or purchases, and respond to inquiries
  • Contact your emergency contact if needed for your safety during a class
  • Send you receipts, class reminders, and service-related notices
  • With your consent, send marketing communications about promotions, new class formats, membership offers, or events
  • Personalize your experience, such as remembering your preferred class format or instructor
  • Maintain the security of our Site, App, and studio, and prevent fraud or abuse
  • Analyze and improve our Services, website, and studio operations
  • Comply with legal obligations and enforce our Terms of Service and studio policies, including our late-cancellation policy
  • Evaluate and process job applications submitted through our careers page

We do not use your emergency contact information, health information, or payment information for marketing purposes.


4. How we share your information

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes without your consent. We may share information as follows:

  • Service providers: vendors who perform functions on our behalf, such as our booking platform (AXLE), payment processor, website host (Netlify) and domain/DNS provider, email and productivity tools (Google Workspace), and marketing or analytics platforms.
  • Business partners: entities we work with for co-branded promotions, referral programs, or joint events, with your consent where required.
  • Legal and safety purposes: when required to comply with a subpoena, court order, or other legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of TerraCut, our staff, clients, or the public.
  • Business transfers: if TerraCut is involved in a merger, acquisition, financing, or sale of assets, client information may be transferred as part of that transaction.
  • Aggregated or de-identified information: we may share information that does not identify you for research, reporting, or marketing purposes.
  • With your consent or at your direction.

5. Data retention

We keep personal information only as long as necessary for the purposes described in this Policy, unless a longer retention period is required by law.

6. Security of your information

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, disclosure, alteration, or destruction. Payment and other sensitive data are transmitted over encrypted (SSL/TLS) connections. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. You are responsible for keeping your account password confidential and for all activity under your account.


7. Your choices

7.1 Marketing communications

If you opt in to receive marketing emails or texts, you can unsubscribe at any time using the link or instructions at the bottom of each message, or by contacting us directly. Please allow up to 10 business days for us to process an opt-out request. You will continue to receive non-promotional messages related to your account, bookings, or purchases even after opting out of marketing.

7.2 Texts and calls

If you provide your phone number and consent to receive texts or calls (such as class reminders or waitlist notifications), you can opt out at any time by replying STOP to a text or contacting us directly. Message and data rates may apply.

7.3 Cookies and location services

You can manage cookies through your browser settings and manage location, contacts, or calendar permissions through your device settings. Disabling certain features may limit some Site or App functionality, such as location-based studio search.


8. Access to and correction of your information

You can review and update most of your personal information by logging into your account or by contacting us at info@terracutstudios.com. Copies of information you have updated or deleted may remain viewable in cached or archived pages for a period of time.


9. Children's privacy

Our Services are not directed to children, and we do not knowingly collect personal information from anyone under the age of 13 without verifiable parental consent, consistent with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take steps to delete it. 10. Additional disclosures for California residents

This section applies to California residents and supplements the rest of this Policy, as required by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

10.1 Categories of personal information collected

In the preceding 12 months, we have collected the following categories of personal information, as defined by the CCPA: identifiers (name, email, IP address); customer records (billing/shipping address, phone number, payment card information); protected classifications (age, gender); commercial information (purchases, booking history); internet activity (Site and App interactions); geolocation data; audio/visual data (CCTV footage); professional/employment information (job applicants); and inferences about your preferences (such as preferred class format).

10.2 Sources and purposes

See Sections 1 and 3 above for the sources from which we collect this information and the business purposes for which we use it.

10.3 Sale or sharing of information

TerraCut does not sell personal information for money. To the extent certain advertising or analytics cookies are considered a "sale" or "sharing" of personal information under the CCPA, you may opt out by adjusting your cookie preferences or contacting us at info@terracutstudios.com.

10.4 Your rights

California residents may have the right to:

  • Know the categories and specific pieces of personal information we have collected about you
  • Delete personal information we have collected from you, subject to certain exceptions
  • Correct inaccurate personal information
  • Opt out of the sale or sharing of personal information
  • Limit the use of sensitive personal information
  • Not be discriminated against for exercising any of these rights

To exercise these rights, contact us at info@terracutstudios.com. We will verify your identity before fulfilling your request and will respond within the timeframe required by law. You may also designate an authorized agent to submit a request on your behalf, subject to verification.

10.5 Minors

We do not knowingly sell or share the personal information of minors under 16 without affirmative authorization, as required by the CCPA.

10.6 Shine the Light

California residents may request, once per year, information about the personal information we shared with third parties for their own direct marketing purposes, by contacting us at info@terracutstudios.com.


11. Additional disclosures for Nevada residents

Nevada residents have the right to submit a request directing us not to sell certain categories of personal information, to the extent we engage in a "sale" as defined under Nevada law. TerraCut does not currently sell personal information in this manner. If you have questions or wish to submit a request, contact us at info@terracutstudios.com.


Our Site, App, and marketing materials may contain links to third-party websites or platforms (such as our booking system, payment processor, or social media pages) that are not operated by TerraCut. This Policy does not apply to those third-party sites, and we encourage you to review their privacy policies separately.


13. Changes to this policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where changes are material, provide additional notice (such as a banner on the Site or an email). Your continued use of our Services after changes take effect constitutes acceptance of the revised Policy.
